consent about business relation between each other with following sections.

Data processing consent

Client hereby give the consent to the Azbar Europe to collect and process his personal and business data in order to provide technical support and inform about news, special offers, digests, on services and products offered by the company under brand Azbar Europe and related brands [i.e. for marketing purposes].

Client confirm that is properly informed on all information under Article 13 of the Regulation [EU] 2016/679 of the European Parliament and of the Council on the protection of natural persons with regard to the processing of personal data and on the free movement of such data, and repealing Directive 95/46/EC [General Data Protection Regulation].

Confidentiality

Confidential Information means information of commercial value which is kept confidential by Azbar Europe and which shall not come into the public in accordance with these Agreement. Confidential Information includes all information disclosed by Azbar Europe or its directors, employees and, professional advisers to the Client, whether disclosed orally or in writing and, without prejudice to the generality of the foregoing, may include information relating to the Azbar Europe’s technologies, Website, researches, products, software, services, development, creative projects, inventions, industrial patterns, drawings, design documentation, marketing or finances of Azbar Europe.

The Client undertakes the obligations to keep the confidentiality of the Confidential Information received from Azbar Europe.

The Client shall use all commercially reasonable efforts to protect the Confidential Information from any harm, tampering, unauthorized access, sabotage, exploitation, manipulation, modification, interference, misuse, misappropriation, copying or disclosure.

Azbar Europe undertakes the obligations to keep the confidentiality of the Confidential Information from Client and related data, with or without Support executed and only can use them with written signature from the Client.

Support License Agreement

When using, requesting to use and purchasing subscription for Support Services or Support Services rendered under a outside agreement the Client acknowledges that they have read this Agreement, agree to the content of the Agreement and its terms, and agree to use the Support Services in compliance with this Agreement and Website Terms.

Azbar Europe reserves the right at any time at its sole discretion to change the Support Services and/or this Agreement. Client’s use of the Support Services after the effective date of any such change constitutes their acceptance of the changed Support Services and Agreement

Licence

Client acknowledges that the Support Services within the respective support subscription and/or SLA contract are non-transferable and can only be applied to the Client account the purchase was made through and the Software/Products acquired for that account.

Subscriptions

Subscriptions are not refundable and not transferable and it is valid 10 days after full payment and activation.

Support Services

Support Services may include but are not limited to: pre-sale consultations, product functionality consultations, installation and configuration consultations, issue verification on non-customized environments, issue verification on Client  environment, issue resolution and debugging in case such resolution is possible/viable, installation service, configuration service, updates installation service, screen sharing, and video calls for configuration questions and preliminary technical investigation.

Support Services are provided on-demand basis only, where the Client is required to submit a corresponding request by means of Azbar Europe ticket support system by email/web form.

Applicable Law and Dispute Resolution

Any issue which is not agreed in these Agreement will be governed by the laws of Croatia.

The parties will endeavor to resolve all disputes, controversies and claims that may arise in connection with the execution, termination or invalidation of these Agreement by negotiations. If dispute, disagreement or claim was not solved by negotiations, such dispute shall be resolved by using ODR platform.
